1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”) and Sweet Revenge Barbecue Company (“Company,” “we,” “us,” or “our”), concerning your access to and use of our websites, fundraising platforms, digital order forms, mobile applications, and any related services (collectively, the “Platform”).
By accessing or using the Platform, you agree that you have read, understood, and are bound by these Terms. If you do not agree, you must discontinue use immediately.
We may update these Terms from time to time. Updates will be effective when posted, with the “Last Updated” date revised accordingly. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
The Platform is operated in the United States. Those who access from other jurisdictions are responsible for compliance with local laws. The Platform is not intended to comply with industry-specific regulations (e.g., HIPAA, FISMA, GLBA). If your use would subject us to such laws, you may not use the Platform.
Minors under 18 must have a parent or guardian review and agree to these Terms before use.

2. INTELLECTUAL PROPERTY RIGHTS
All content on the Platform—including source code, databases, designs, text, graphics, logos, trademarks, service marks, and other materials (“Content”)—is owned or licensed by us and protected by U.S. and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal or organizational fundraising purposes only. Except as expressly allowed, you may not copy, reproduce, republish, upload, post, transmit, sell, or exploit any Content without our prior written consent.

3. USER REPRESENTATIONS
By using the Platform, you represent and warrant that:

1. All information you provide will be true, accurate, current, and complete.
2. You will maintain the accuracy of such information and promptly update it as necessary.
3. You have the legal capacity to enter into these Terms.
4. If you are under 18, you have obtained parental consent.
5. You will not access the Platform using bots, scripts, or other automated means.
6. You will not use the Platform for illegal or unauthorized purposes.
7. Your use will comply with all applicable laws and regulations.

We reserve the right to suspend or terminate your access if these representations are violated.

4. USER REGISTRATION
You may be required to register with the Platform. You agree to maintain the confidentiality of your login credentials and accept responsibility for all activity under your account.

5. PROHIBITED ACTIVITIES
You may not use the Platform for purposes other than those intended. Specifically, you agree not to:

• Engage in data scraping, mining, or automated data collection.
• Upload or transmit viruses, malware, spyware, or disruptive code.
• Harass, abuse, intimidate, or harm other users or our staff.
• Attempt to bypass security features or access restricted areas.
• Use the Platform to send spam, pyramid schemes, or unauthorized advertising.
• Reverse engineer, decompile, or disassemble Platform software.
• Collect personal data of other users without consent.
• Impersonate another person or entity.
• Use the Platform in connection with fraudulent or misleading fundraising.

6. USER CONTRIBUTIONS
The Platform may allow you to submit content (e.g., fundraising pages, names, media, or feedback). By submitting content, you represent that:

• You own or have necessary rights to the content.
• Your contributions do not infringe third-party rights.
• Your contributions are not defamatory, obscene, harassing, hateful, or unlawful.
• Your contributions do not promote violence or discrimination.

We reserve the right to remove content that violates these standards.

7. PRIVACY POLICY
We care about data privacy and security. By using the Platform, you agree to the terms of our Privacy Policy, which is incorporated herein. Please note: the Platform is hosted in the United States, and by using it you consent to the transfer and processing of your data in the U.S.

8. FUNDRAISING PARTICIPATION AND FULFILLMENT TERMS
a. Organization Responsibilities

• Provide accurate organization and contact information.
• Actively promote the fundraiser within your community.
• Assign a coordinator to communicate with us.
• Ensure participants use assigned links truthfully.

b. Campaign Tiers

• Essential: “Perfect for small groups getting started. Free to launch, 25% earnings, simple reporting each week.”
• Growth: “Designed for teams ready to scale. Includes weekly reporting, core digital tools, and support when you need it. 30% earnings.”
• Impact Partner: “Best for high-performing organizations with big goals. 32% earnings, top-seller incentives, full tool access, dedicated support, and eligibility for exclusive bonuses.”

c. Payments

• Customer payments are processed digitally.
• Payouts (and bonuses if applicable) are mailed within 7 business days of campaign conclusion.
• Organizations are responsible for providing valid payment details.

d. Delivery & Shipping

• Orders are fulfilled via shipping carriers or local delivery.
• Delivery timelines may vary by location and availability.
• For shipped orders, our responsibility ends at confirmed delivery.

e. Platform Use

• The Platform and its tools are proprietary to the Company.
• Misuse, misrepresentation, or violation of these Terms may result in access termination.

9. LIMITATION OF LIABILITY
We provide the Platform “AS IS” and disclaim all warranties, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including lost profits or data.

10. TERMINATION
We reserve the right to suspend or terminate your access to the Platform for violation of these Terms or misuse of services.

11. GOVERNING LAW
These Terms are governed by and construed under the laws of the State of Indiana, without regard to conflict-of-law principles.
